Premium Storage Terms and Conditions

1. Description of Services

RaceStation provides Premium Storage Customers with:

• Access to the RaceStation mechanic service facilities.
• Assigned or shared vehicle and equipment storage within the RaceStation garage.
• Courtesy use of onsite tools and shop equipment (subject to availability).

2. 12-Month Commitment, Cancellation & Fees

• 2.1 Term: This Agreement is for a mandatory term of twelve (12) consecutive months from the date of subscription.
• 2.2 Early Termination: Customer acknowledges that the membership fee is a year-long commitment. If Customer cancels or terminates service for any reason prior to the end of the 12-month term, the entire remaining balance of the 12-month term shall become due and payable immediately.
• 2.3 Non-Refundable: All payments made are non-refundable.
• 2.4 Price Adjustments: The monthly subscription fee is based on current facility operating costs. RaceStation LLC reserves the right to increase the monthly fee at any time to reflect documented increases in RaceStation's underlying lease or utility costs at the Utah Motorsports Campus. RaceStation will provide Customer with at least thirty (30) days' written notice prior to any price adjustment taking effect.

3. Facility Access & Security

• 3.1 Shared Facility: Customer acknowledges that the garage is a shared workspace. Multiple persons, including other customers, staff, and contractors, have authorized access to the garage where Customer's vehicles and equipment are stored.
• 3.2 UMC Policies: Access to the facility is strictly subject to the access and security policies of the Utah Motorsports Campus (UMC). RaceStation is not responsible for any changes to UMC policies that may restrict or alter facility access.
• 3.3 Right to Relocate: RaceStation reserves the right to reassign storage spaces or relocate Customer's vehicles and equipment within the facility at its sole discretion for operational efficiency or safety requirements.

4. Limitation of Liability & Release

• 4.1 Assumption of Risk: Customer stores vehicles and equipment at their own risk. RaceStation does not provide insurance for Customer property.
• 4.2 Theft and Damage: RaceStation LLC shall not be liable for any loss, theft, or damage to Customer's vehicles, trailers, parts, tools, or personal property, regardless of how such damage or loss occurs, including but not limited to fire, water damage, or the acts of third parties with access to the facility.
• 4.3 Insurance Requirement: Customer is strongly encouraged to maintain their own comprehensive insurance policy for all property stored on the premises.

5. Tools, Equipment & Conduct

• 5.1 Courtesy Use: Tools and shop equipment are provided as a courtesy only. RaceStation does not guarantee availability or warranty the condition of tools ("as-is").
• 5.2 Loss and Damage: If tools are lost, stolen, or damaged, RaceStation is under no obligation to replace them. Customer may be held liable for damage caused by gross negligence or intentional misuse.
• 5.3 Safety & Conduct: Customer agrees to abide by all posted shop safety rules. RaceStation reserves the right to terminate this Agreement immediately and without refund if Customer engages in unsafe behavior, harassment of others, or intentional misuse of facility property.

6. Abandoned Property

If a Customer's account remains unpaid for more than ninety (90) days, any property remaining on-site shall be deemed abandoned. RaceStation reserves the right to remove, store, or dispose of abandoned property at the Customer's expense, subject to Utah self-storage and lien laws.

7. Governing Law

This Agreement shall be governed by the laws of the State of Utah. Any disputes shall be resolved in the courts of Tooele County or Salt Lake County, Utah.
